IRS Payment Plans and Installment Agreements, Set Up by an Enrolled Agent in Raleigh

An IRS payment plan, formally an installment agreement, turns a tax balance you cannot pay in full into a monthly payment you can carry. The IRS accepts them every day. The questions are how much you pay each month, whether penalties keep piling up, and whether a levy is about to land in the meantime. James handles all three.

  • Monthly payment set at what you can actually afford
  • Levies and garnishments released once the plan is in place
  • Penalty relief requested where your history supports it
  • Plans for balances over $50,000 that the online tool cannot handle
  • NC Department of Revenue payment plans arranged alongside the IRS

The IRS would rather be paid slowly than not at all, and its installment agreement program exists for exactly that reason. The job is to get a plan you can actually keep, stop any levy that is already moving, and make sure penalties are not quietly doubling the bill while you pay.

When you can do it yourself, and when you should not

If every return is filed and you owe $50,000 or less including penalties and interest, you can usually set up a payment plan with the IRS online and it will be accepted on the spot, and James will tell you so. People come to him when one of these is true:

The kinds of IRS payment plans

PlanWho it fitsWhat it takes
Short-term payment planBalances you can clear within 180 daysA request; no setup fee
Streamlined installment agreementUp to $50,000, paid over up to 72 monthsAll returns filed; no financial statement
Non-streamlined installment agreementLarger balances or longer termsForm 433 financial statement, reviewed by the IRS
Partial payment installment agreementCannot pay the full balance before the collection deadlineFinancial statement showing limited ability to pay
Currently Not CollectibleNo ability to pay without hardshipFinancial statement; collection paused, interest continues

You may also see the phrase IRS Fresh Start. It is the IRS’s name for its 2011 expansion of streamlined plans and lien thresholds, not a separate program, and nothing on this page requires applying for it. If even a partial payment plan is out of reach, settling for less than you owe through an Offer in Compromise may be the answer.

How James sets up your plan

  1. Transcripts firstHe pulls your IRS account to confirm the real balance, which years are open, and whether any return is missing. Missing returns get prepared and filed before the plan is requested.
  2. The right plan at the right numberFor larger balances he prepares the financial statement so your necessary living expenses are fully counted, which is what determines the monthly payment.
  3. Levy release and penalty reliefWith the plan in place he requests release of any levy or garnishment and asks for first-time or reasonable-cause penalty abatement where your record supports it.

Business owners: payroll tax balances need a plan fast

Unpaid payroll taxes get the IRS’s attention faster than any other balance, and the trust fund recovery penalty can make the owner personally liable. In-business trust fund express agreements exist for smaller balances, and larger ones need a careful financial presentation. If this is your situation, call the week the notice arrives, not the month after.

North Carolina payment plans

The NC Department of Revenue has its own installment process, its own forms and its own willingness to levy, and an NCDOR payment plan has to be requested separately. When federal and state balances exist together, James sets both up so one does not break the other, and so the combined monthly figure is one you can keep. This is a common situation and a routine part of our IRS tax resolution work.

Already on a plan and about to miss a payment? Call before the due date. Plans can often be revised; a terminated plan starts the whole process over.

Questions clients ask

Can I set up an IRS payment plan myself online?

If you owe $50,000 or less in combined tax, penalties and interest and all your returns are filed, the IRS online payment agreement tool will usually accept a plan. People come to James when the balance is higher, returns are missing, a previous plan defaulted, a levy is already in motion, or the proposed payment is more than they can afford.

How much will my monthly payment be?

For balances up to $50,000 the IRS generally accepts the balance spread over 72 months. Above that, or when that figure is too high, the payment is based on a financial statement showing your income and necessary living expenses. Preparing that statement well is where an Enrolled Agent earns the fee.

Do penalties and interest stop once I am on a plan?

Interest continues until the balance is paid. The failure-to-pay penalty is reduced while the plan is current. James also requests first-time penalty abatement or reasonable-cause relief when your filing history qualifies, which can remove a meaningful part of the balance.

What happens if I miss a payment?

One missed payment usually brings a notice of intent to terminate the agreement, and a terminated plan puts you back where you started. Call James before you miss a payment rather than after; plans can often be revised.

Does North Carolina offer payment plans too?

Yes. The NC Department of Revenue has its own installment process with its own rules. When you owe both, James coordinates the two so a state levy does not blow up the federal plan.

What is Currently Not Collectible status?

If paying anything would leave you unable to cover basic living expenses, the IRS can place your account in Currently Not Collectible status, which pauses collection. It is not forgiveness, but it stops levies while your situation improves. James will tell you if you qualify.
